Spencer Elden, the man whose unusual baby portrait was used for one of the most recognizable album covers of all time, Nirvana’s “Nevermind,” filed a lawsuit Tuesday alleging that the nude image constituted child pornography.
The cover art subject — who, like the “Nevermind” album itself, is now 30 — is asking at least $150,000 from each of the defendants, who include include surviving band members Dave Grohl and Krist Novoselic; Courtney Love, the executor of Kurt Cobain’s estate; Guy Oseary and Heather Parry, managers of Cobain’s estate; photographer Kirk Weddle; art director Robert Fisher; and a number of existing or defunct record companies that released or distributed the album in the last three decades.
Curiously, original Nirvana drummer Chad Channing is also named as a defendant who was part of the group at the time, even though he had been replaced by Grohl in 1990, before the album was recorded or the cover photography shot.

However, his enthusiasm appears to have waned in recent years. In a 2016 interview with GQ Australia, Elden said his stance on the photograph changed after he reached out to Nirvana to see if the band would participate in an art show he was putting on. “I was asking if they wanted to put a piece of art in the fucking thing,” he said. “I was getting referred to their managers and their lawyers. Why am I still on their cover if I’m not that big of a deal?”
In that same interview, Elden discussed the negative aspects of the notoriety, too. When asked if the cover affected his relationships, he said, “Totally. Everyone thinks you’re making money from it.”
“You’ll hook up with a hot chick, and then they figure out you’re not making any money from it and they’ll dump you,” he went on. “You have these people who think you’re cool because you’re the Nirvana baby. But it’s fucking weird, man. It’s like that dream where you go to school without your clothes on.”

There is a presumption against vicarious liability but I'm wondering if her conduct amounts to negligence as she should have known and ought to have known that she was too stupid to reproduce. The Statement of Claim would be a goodun: The plaintiffs state that the defendant ( hereinafter Maggie ) should have had herself sterilized before gang banging the Rolling Stones. The plaintiffs state further that Maggie should have just blown Fidel Castro rather than banging him outright and carrying his bastard child to term. The plaintiffs state etc. ..lol

If we win we can get back some of the money she got from WE. Absent a declaration of legal incompetence people are deemed competent and therefor responsible for their actions. Maggie is presumed to be competent and so far there’s no stupidity defence available in canada so she’s out of luck on that one. The Law of negligence requires people to conduct themselves according to certain standards. Producing shit-apple offspring that fuck the place up for everyone else arguably falls below those standards however case law would need to evolve a bit to acknowledge such contingency as a head of damage. Too bad though because it would be a growth area for litigation around Toronto and I’m looking to expand the range of services that I can offer .. lol
